Cannabis Act: Canada set to legalise marijuana to keep children 'safe'

Canadian Prime Minister Justin Trudeau, who said he would work toward legalizing marijuana in the country during his campaign, possibly saw his popularity get higher Thursday when he introduced legislation legalizing the recreational use of cannabis in the country.

The bill, known as "An Act respecting cannabis and to amend the Controlled Drugs and Substances Act, the Criminal Code and other Acts", would set a minimum age limit of 18, although each province would be free to set their own limit above that age. "We need to make sure that it's harder for underage Canadians to access marijuana, and that will happen under a controlled and regulated regime", he said at an economic conference a year ago.

- Adults 18 and older would be allowed to publicly possess up to 30 grams of dried cannabis, or its equivalent in non-dried form. Adults would be allowed to produce legal cannabis products such as food or drinks, for personal use at home.

The proposed legislation would create new criminal offences with maximum penalties of 14 years in jail to anyone who sells or gives cannabis to youth.

It noted that in the handful of U.S. states where recreational marijuana use is legal, the minimum age was set at 21, in line with alcohol consumption. The marijuana task force led by former Liberal justice minister Anne McLellan had acknowledged provinces and territories would likely harmonize it with the age limit they now have in place for alcohol and tobacco.

The federal government has said it hopes to provide regulated and restricted access to marijuana no later than July 2018. The proposed legislation will be carefully scrutinized by provincial governments, marijuana producers and a number of would-be distributors and sellers of marijuana that are all looking for a piece of the multibillion-dollar market.

The South American nation of Uruguay is the only country that has legalized marijuana for recreational use.

Although the government has not decided anything about the endorsement of marijuana, reports suggest that the government has indicated that any marketing that would appeal young people will be prohibited.

The Canadian Automobile Association says that level of funding "is clearly inadequate, given the misconceptions about marijuana's effect on driving".

The current legislation on the drug is simply not working, the country's government admitted, as it revealed plans to make the drug legally available. But exporting and importing marijuana will remain illegal without a valid permit for special purposes, such as medical marijuana, which is legal in Canada, and industrial hemp. "This needs to be an orderly transition", he said.

Executive vice-president of Aurora Cannabis Inc., Cam Battley, says nobody should be promoting cannabis to young people, but he expects the restrictions will evolve over time to be more aligned with how alcohol companies can package their products.
