Senate chairman: Flynn has not responded to subpoena

Attorneys for former USA national security adviser Michael Flynn have said he will not honor a subpoena from the Senate Intelligence Committee requesting documents related to his communications with Russian officials, Committee Chair Richard Burr, a Republican, told the Associated Press on Thursday.

The Senate subpoenaed the former National Security Adviser last week as part of an investigation of President Donald Trump's ties to Russian Federation.

Asked about his opinion of the president now, Flynn reiterated his loyalty to Trump.

The Associated Press reported Thursday morning that, according to a Republican member of the Senate Intelligence panel, Michael Flynn's lawyers said that Flynn will not obey a subpoena. 'We're continuing on with a lot of interviews and through those interviews it leads us to additional document requests and additional individuals we'd like to talk to, ' Burr told reporters in the Capitol Thursday, CNN reported. Burr then walked back his statements, indicating that he may have spoken too soon, and the committee then corrected Burr's comments to say that Flynn's lawyer has not yet responded.

Flynn, a retired Army lieutenant general, was sacked from his position as Trump's national security adviser in February. On Jan. 26, former deputy Attorney General Sally Yates told McGahn, who had transitioned into role of White House Counsel, that the DOJ possessed evidence that Flynn had not been forthcoming to Vice President Mike Pence about his communications with Russian officials.

The committee issued the subpoena last week, seeking "a large number of documents" after Flynn's lawyer informed the panel that Flynn would not be complying with an April 28 request to hand over the same documents voluntarily.

If Flynn declines to comply with the subpoena, the intelligence committee could have little legal recourse.

For example, Republicans never heard testimony from Hillary Clinton's former technology aide about her private email server despite a subpoena and committee vote to hold him in contempt.

"The criminal contempt process takes forever - you vote [for] it and then it goes to the USA attorney and he has to decide what to do with it", senior counsel Stanley Brand of the Akin Gump firm told Politico. "No matter what option they take, it's not quick".
