'Making a Murderer': Federal court upholds overturned conviction

Making a Murderer was one of the most popular Netflix original documentaries when it premiered on the streaming service.

Netflix publicized a documentary in 2015 called "Making a Murderer", which highlighted the case but, according to authorities, was biased.

Avery was also sentenced to life after being convicted of first-degree intentional homicide in a separate trial. Avery previously served 18 years in prison for the wrongful conviction of sexual assault and attempted murder of Penny Beerntsen, before being fully exonerated in 2003 through DNA evidence.

A federal magistrate judge in Wisconsin ruled in August that investigators coerced Brendan Dassey into confessing and overturned his conviction.

Zellner tells WBAY the 7th Circuit Court panel's opinion upholding a lower court's ruling that Dassey's confession was involuntary makes Avery optimistic about his future. Instead, the state appealed the judge's decision, keeping Dassey in prison and leaving a federal appeals court to decide if his conviction should be overturned or not. They now have 90 days from the court's order to retry him, and state attorneys could also appeal the case to the U.S. Supreme Court.
